By browsing this Website or ordering through EverPaw™, you affirm and warrant that you are at least the legal age of majority in your jurisdiction of residence, and possess the full legal standing and capacity to enter into binding agreements with EverPaw™.

2. Privacy & Pet Memory Protection

Your uploaded family pet photos, audio memos, and payment records are safeguarded under our dedicated Privacy Policy. We strictly pledge that submitted pet memories will never be commercialized or sold to third-party data brokers.

3. Uploaded Pet Media & Intellectual Property Representation

When you provide photos, audio, or video footage of your pet, you represent and warrant that you own or possess lawful rights to such imagery. You grant EverPaw™ a limited, non-commercial license solely for the purpose of 3D modeling, artistic rendering, private preview simulation, and hardware loading for your bespoke order.

4. Personal Memorial & Residential Use Only

All EverPaw™ standalone holographic hardware devices, bespoke animations, holiday backdrops, and commemorative certificates are sold strictly for personal, domestic keepsake display. Unauthorized commercial exploitation, electronic duplication, software extraction, or unauthorized resale without express written consent from EverPaw™ is strictly prohibited.

5. Visual Approvals & Rendition Accuracy

Because each holographic keepsake is individually sculpted by 3D animators from client photographs, artistic nuances may subtly reflect the quality and resolution of your source media. We make every reasonable effort to render fur tones, eyes, and markings faithfully. Our Unlimited Free Revision Guarantee gives you the right to request adjustments during the digital simulation phase prior to final hardware engraving.

6. Pricing & VIP Motion Upgrades

All prices for standalone hardware devices and bespoke add-ons (including festive seasonal scenes and complex behaviors like Rolling Over, Playing Toys, Happy Dance, or Tug of War) are clearly outlined at checkout. We reserve the right to revise catalog offerings or upgrade tiers at any time without retroactive effect on placed orders.

7. One-Time Payment Terms (Strictly No Subscription Fees)

All transactions are billed in United States Dollars (USD) or your selected storefront local currency equivalent. By completing checkout, you confirm:

• You are authorized to utilize the designated payment card, PayPal, or digital wallet account;
• Our Level-1 PCI-DSS certified gateway is authorized to process the transaction amount;
• No Monthly App Fees or Subscriptions: EverPaw™ is a standalone hardware device requiring zero monthly subscriptions, app payments, or recurring fees.

8. Order Placement, Acceptance & Dispute Protocol

Receipt of an automated checkout confirmation email does not constitute our definitive acceptance of an order. We reserve the right to decline or cancel orders involving suspected fraudulent payment or unusable source files. Cancellation or photo swap requests must be submitted within 12 hours of purchase before our 3D animation team begins digital modeling.

Chargeback Resolution Protocol: Should you have any question concerning your preview video or tracking status, you agree to contact our concierge team at support@trovse.com before filing a payment dispute. Because we provide documented video proof of approval and carrier tracking, fraudulent chargebacks will be formally defended.

9. 3D Production & Express Delivery Timelines

Our bespoke production follows an uncompromising quality timeline:

• 3D Animation & Sculpting: 4–7 business days to craft the personalized digital twin and generate your private video preview;
• Client Approval: Physical hardware finalization will only occur once you give written approval of your private video preview;
• Hardware Loading & Tracked Express Shipping: Typically 7–12 business days via insured express couriers once approved.

10. Delivery Risk & Carrier Status

Risk of loss and title to your EverPaw™ keepsake pass to you upon delivery by the shipping carrier (USPS, FedEx, DHL, or local national post) to your specified destination. Official electronic carrier delivery confirmation constitutes definitive proof of delivery.

11. Custom Keepsake Policy, Cancellation & Hardware Warranty

PLEASE READ CAREFULLY: Because each EverPaw™ device is a completely custom-crafted keepsake uniquely animated, sculpted, and personalized for your specific pet, we are unable to accept returns, cancellations, or refunds once you have approved the digital preview video and hardware production has commenced, unless there is a physical hardware defect or damage.

To ensure total peace of mind, we provide unlimited free revisions on your private video simulation before any physical hardware is manufactured or shipped.

30-Day Hardware Defect & Damage Protection: If your hardware displays electronic failure, optical chamber damage, or transit collision damage upon arrival, contact support@trovse.com within 30 days of receipt with photos or video proof. We will repair or replace the hardware unit completely free of charge.

12. Community & Respectful Commemoration

EverPaw™ maintains community channels for pet parents to share remembrance stories. We reserve the absolute right to remove abusive, commercial, or offensive comments that compromise the healing and respectful nature of our community.

13. Disclaimer of Hardware Warranties

EXCEPT AS EXPRESSLY STATED HEREIN (INCLUDING OUR 30-DAY HARDWARE WARRANTY FOR DEFECTS), ALL PRODUCTS AND DIGITAL RENDERS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EVERPAW™ EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, OR NON-INFRINGEMENT.

14. Disclaimer of Consequential Liabilities & Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY GOVERNING LAW, UNDER NO CIRCUMSTANCES SHALL EVERPAW™, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR 3D ARTISANS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF YOUR USE OF THE WEBSITE OR HARDWARE.

UNDER ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY ARISING FROM ANY ORDER SHALL BE STRICTLY LIMITED TO THE ACTUAL PURCHASE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

15. Mandatory Binding Arbitration & Class Action Waiver

PLEASE READ THIS DISPUTE RESOLUTION CLAUSE WITH CLOSE ATTENTION.

Any dispute, claim, or controversy arising out of or relating to these Terms, your order, or the EverPaw™ hardware shall be settled exclusively through binding, confidential individual arbitration under commercial arbitration standards, rather than in court litigation.

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS OR CONSOLIDATED PROCEEDING.

16. Indemnification

You agree to indemnify, defend, and hold harmless EverPaw™, its owners, officers, and contractors from any third-party claims, losses, damages, liabilities, or legal expenses (including reasonable attorney fees) resulting from your breach of these Terms or unauthorized submission of third-party media.

17. Third-Party Portals & Logistics Links

Links to third-party package tracking services, payment gateways, or external platforms are provided solely for operational convenience. We assume no responsibility or liability for third-party operations or privacy policies.

18. Customer Testimonials & Submissions

If you voluntarily send unboxing videos, heartwarming testimonials, or photos of your display to our team or review wall, you grant EverPaw™ a royalty-free, worldwide license to display such feedback across our memorial gallery to comfort other families. Private photos submitted strictly for custom 3D production remain 100% confidential.

19. DMCA Notice & Copyright Ownership

EverPaw™ respects intellectual property. If you believe your copyright has been infringed, submit a formal DMCA notice to support@trovse.com with the subject line “DMCA Copyright Notice”.

All brand graphics, product casing industrial designs, UI interfaces, and proprietary text are the exclusive property of EverPaw™.

20. Electronic Communications & Receipts

You consent to receive communications from us electronically via email. You agree that all digital notifications, agreements, video preview links, and disclosures satisfy any legal requirement that such communications be in writing.

21. Assignment

You may not transfer or assign any rights under these Terms without our prior written consent. EverPaw™ may assign its operational duties or agreements freely without notice.

22. No Waiver

The failure of EverPaw™ to enforce any provision or right in these Terms shall not be construed as a waiver of that provision or any future right to enforce it.

23. Severability

If any clause of these Terms is determined to be unlawful, invalid, or unenforceable by an arbitrator or court, that specific provision shall be modified to the minimum extent necessary, and all other clauses shall remain in full legal effect.

24. Termination & Survival of Clauses

Sections 11, 13, 14, 15, 16, 18, and 19 shall survive any termination of our services or completed order fulfillment for all lawful purposes.

25. Entire Agreement

These Terms of Service, combined with our Privacy Policy and FAQ Guidelines, constitute the entire legal agreement governing your purchase and use of EverPaw™ products.
